This is my fathers letter I am elizabeth hasara he is jonothan hasara
The facts are:I have 30 years in the National Guard , I am 52 years old
I have a permanent disability and a retirement from the army at 40% I was retired the on 7th Sept 2009,
from a line of duty injury (LOD) which occurred on my 14th month of deployment
I have 80% rating from the veterans affairs (VA)I am now in retried status
My retried pay is off set dollar for dollar from my VA disability
Bottom line is I receive 17.62 dollars a month from the army .because of concurrent receiptDafas has informed me I am ineligible for
Concurrent Retirement and Disability Payments (CRCP)
Because to collect a retirement disability I must be 60 years old.
Dafas also informed me there is no phase out for disabled reserve retries until
They are 60 years old. I have been rejected for Combat-Related Special Compensation Justification/Comments
No evidence in claim the shows that a combat-related event caused this condition.
Documentation indicates the this injury occurred during organized Physical Training
(PT) while attending the ANCOC course, and does not meet the criteria as a combated
related condition under DOD guidance for Simulating War. The PEB states that your
back pain was exacerbated from wearing IBA. Individual Body Armor is considered to
be Organizational Clothing and Individual Equipment (OCIE) and does not meet the
criteria of combat-related special compensation. I guess having the tailgate from HMMWV dropped on hip in a war zone doesn’t count.My unit was deploying me back , before I competed the MEB/PEB board I was reactiveated
With my unit.I have been out of work since the end of February .
The VA has stop my disabled payments for the next 3 months because of this reactivationI have 17.62 from the Army month.
Nothing from VANothing from Social Security A small Annuity from my form job.
As a side note from me elizabeth his daughter id like to remind you all the military dropped a humV tail gate on him severely injuring and disabling his back while breaking several of his adult teeth on combat duty and he is now restricted from doing a lot of the thing he loved to used to do

Your letter says he is reactivated, So he is receiving Full pay and benefits while on active duty.
What are you asking for, more benefits.
The rest of your letter, sounds right in concurrence with the law.
Nothing different or special.

I have been dealing with the VA system since 1970 and what he is saying pretty well runs along with the law (s ) dealing with the VA , the CRCP and CRSC . Write your congressperson if you feel things aren’t right , this is an election year and you have a better chance of getting something done now than after the fall elections.

Bottom line, have him contact the DAV…Disabled American Veterans. They are the best group to deal with him. My son got a 10% from the Navy for a disability in the first gulf war. DAV first got it increased to 40%. He went to college with full tuition, books and a monthly living allowance. Since then, he has had it increased to 60% because of problems caused by his initial disability.
Do not stop at GO, do not collect $200, go DIRECTLY to the DAV.

I’m still waiting for the VA to pay for last semester’s college fees which will probably now keep me from going this semester. Apparently they "lost the paperwork" same thing probably happened to your dad.
